Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Postbrander service ("Postbrander", the "Service"), provided by SEOBurf, a sole trader business operated by James Burfield based in the United Kingdom ("we", "us", "our"). By creating an account or using the Service you agree to be bound by these Terms.
1. Acceptance of terms
By signing up for, accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract under the laws of your jurisdiction to use the Service. By using the Service you represent and warrant that you meet these requirements.
3. Account registration and LinkedIn connection
You register for the Service using LinkedIn Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.
By connecting your LinkedIn account, you authorise the Service to publish posts on your LinkedIn profile in accordance with your instructions and the schedules you set.
4. Subscription and billing
The Service offers a free tier with limited usage and may, in future, offer paid subscription plans. Pricing, plan features and usage limits are described on our pricing page and may change from time to time.
When paid plans become available, payments are processed by Stripe and are billed in advance on a recurring basis (monthly or annually, as selected). Subscriptions automatically renew until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
Except as required by law, fees are non-refundable. We may change pricing on at least 30 days' notice; price changes do not apply retroactively.
5. Acceptable use
You agree not to use the Service to:
- Send spam, unsolicited messages, or post deceptive content.
- Impersonate any person or entity, or misrepresent your affiliation.
- Post content that is illegal, defamatory, harassing, hateful, obscene, threatening, infringing, or otherwise harmful.
- Infringe any intellectual property, privacy or publicity rights.
- Attempt to reverse engineer, scrape, overload, disrupt or gain unauthorised access to the Service.
- Use the Service to publish content in a way that violates the LinkedIn User Agreement, Professional Community Policies or any other LinkedIn rules.
- Resell, sublicense or otherwise commercially exploit the Service without our prior written consent.
6. LinkedIn compliance
You are responsible for complying with LinkedIn's User Agreement, Professional Community Policies and any other applicable LinkedIn rules and guidelines when using the Service. Any breach of LinkedIn's terms is also a breach of these Terms and may result in suspension or termination of your Postbrander account.
7. Your content
You retain all ownership of the posts, drafts, voice profiles, examples and other content you create or upload to the Service ("Your Content").
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display Your Content solely to provide and improve the Service, including transmitting it to our AI provider for generation, and publishing it to LinkedIn on your instructions.
You are solely responsible for Your Content and confirm that you have all necessary rights to it.
8. AI-generated content
The Service uses third-party AI models (currently Anthropic's Claude) to generate text. AI output may be inaccurate, biased or repetitive. You are responsible for reviewing AI-generated content before scheduling or publishing it. We make no warranty that AI output is accurate, original, or fit for any particular purpose.
9. Service modifications
We may add, remove or change features of the Service at any time. We may also impose limits on usage or storage, or restrict access to features. We will use reasonable efforts to notify you of material changes that adversely affect paying customers.
10. Termination
You may cancel your account at any time from your settings.
We may suspend or terminate your account immediately, without notice, if you breach these Terms, if your use poses a security or legal risk, or if required by law. On termination, your right to use the Service ceases. Sections that by their nature should survive termination (including ownership, disclaimers, liability limits, indemnification and governing law) will survive.
11. Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected.
We are not affiliated with or endorsed by LinkedIn Corporation. LinkedIn may at any time change its API, suspend access, or change its terms in ways that affect the Service.
12. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including loss of profits, revenue, data, goodwill, business opportunity, or LinkedIn account suspension, arising out of or relating to your use of the Service.
Our total aggregate liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) GBP 50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under English law, including liability for death or personal injury caused by negligence or for fraud.
13. Indemnification
You agree to indemnify, defend and hold harmless SEOBurf and James Burfield from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third-party right, including any LinkedIn rule or applicable law.
14. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that we may bring claims in the courts of any jurisdiction where you reside.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
